Regulatory Compliance Advisory
“When the Regulatory Compliance Team are successful on a Project, nobody will praise their work as it is often considered expected that the asset complies with the regulations and that all permits and licenses are granted; whereas the whole world will jump if non-compliances are raised that could impair the execution of the Project”
Regulatory compliance for offshore assets can be divided into three main typical categories.
- Class and Flag – These requirements are for floating assets like FPSOs, Semi -submersibles, SPARs, TLPs etc. They are mainly based on the international regulations from the International Maritime Organization (IMO), namely the SOLAS Convention, the MODU Code and other associated Codes and Convention like MARPOL Convention, LSA Code, FSS Code etc. Class requirements are managed by Classification society e.g. DNV, ABS, LR as the Recognised Organizations (RO) by the respective flag states.
- Coastal State requirements are specific to the country where the unit is operating and may vary from very prescriptive items (like in Malaysia, Norway or Brazil for instance) or Goal-based / Risk- based requirements (like in the UK Safety Case regime). Here Kensa Marine is able to support detailed development of regulatory compliance management plans, specific procedures for each regulation with exact templates to enable compliance.
- Standards for the design and operation of offshore units – Even if not strictly part of the RC scope, as they are intrinsically not compulsory, they have to be complied with through the Class, Flag, or Coastal State requirements. An example for this would be the IEC 60079 referenced by most flag states.
Kensa Marine has experienced personnel in offshore installation Regulatory Compliance in Malaysia, Brazil and Australia.
However, we live in a real world, and if we want to achieve the highest desirable level of Regulatory Compliance, we need dedicated people in the Organization to be responsible for supporting the company’s employees by identifying the regulatory requirements, making them easily understandable to all, providing advice on how to comply with them, supporting the departments, teams, and individuals in order to implement the requirements and assess the level of compliance of their work.
